The latest research from Marathon Strategies highlights a deepening crisis for businesses, as nuclear verdicts—those exceeding $10 million—become increasingly untethered from traditional jurisdictional limits. For the second consecutive year, juries delivered over 40 "thermo-nuclear" awards surpassing $100 million, with four individual cases resulting in payouts exceeding $1 billion. This escalation affects 68 distinct industries, a significant jump from 55 the year prior.
Phil Singer, founder and CEO of Marathon, suggests that the predictability of litigation risk has collapsed. Corporations are now facing a fragmented landscape where traditional legal defenses are frequently bypassed by evolving plaintiff strategies. Beverage companies bore the brunt of the financial impact with $3.8 billion in aggregate verdicts, while products liability cases remained the primary engine of litigation, accounting for $12 billion in awards across 29 instances.
